Processing of contact details

If you contact us by email, we will store the personal data you transmit (such as your name, email, address, place of residence and telephone number) for the purposes of processing your enquiry in accordance with the guidelines of the GDPR. We will delete your data if no contract or order is concluded. We will treat all other information (e.g. project documents) sent along with your enquiry as confidential. The data will not be shared with third parties without the consent of the user.

Applications

The application documents of unsuccessful applicants shall be retained for at least six months due to the possibility of equal treatment claims being filed (Sections 15 (1) and 29 (1) of the Austrian Federal Equal Treatment Act (GlbG), Section 7k (1) in conjunction with (2) no. 1 of the Austrian Disability Employment Act (BEeinstG)), or for three years in so far as a claim could be filed for the reimbursement of the costs of attending an interview (Section 1486 no. 5 of the General Civil Code (ABGB)). Furthermore, retention only occurs if the unsuccessful applicant agrees to their documents being kept on record.

Data collection

We only process the data that you, the customer, share with us for the purposes of taking steps prior to entering into a contract and upon the conclusion of the contract. We usually only need your contact details for this (your name, title, gender, address, telephone number and bank details). In exceptional cases, we might also be forced to ask you to provide other data (such as your date of birth and commercial register data).

Use of data

We shall only use your data to execute the contract, respond to your enquiries, for accounting and settlement purposes and for the technical administration of the project.

Data processing

As part of our business relationship, the data you provide will be processed automatically (e.g. email correspondence, drawing and word processing programs) and in the form of archived text documents (e.g. correspondence, contracts, plans, appraisals, technical reports, judgements, reference files and personalised invoices) in order to take steps prior to entering into a contract and be able to execute the contract.

Data disclosure

We shall only disclose your personal data if necessary for the purposes of executing the contract or billing, in compliance with statutory requirements or if you have given your consent. Personal or project-specific data shall not be used for advertising purposes or in publications without your express consent.

Backing up and deletion of data

Your data will be erased when they are no longer needed to achieve the purpose for which they were stored or if the storage of the data becomes unlawful for legal reasons.

The data necessary to comply with accounting obligations (Sections 190 and 212 of the Austrian Business Code (UGB)) and fiscal requirements (Section 132 of the Austrian Federal Fiscal Code (BAO)) shall always be retained for seven years. Furthermore, on a case-by-case basis, data shall be retained for longer until the end of the business relationship or a legal dispute, or until the expiry of the warranty and guarantee periods, as well as the limitation periods in the event that claims for compensation are filed, or in so far as necessary in order to file copyright claims.

Furthermore, all data stored in the electronic archive of documents are subject to a retention period of at least 30 years (Section 13 of the Austrian Archive Ordinance – 220th Ordinance of the Federal Chamber of Architects and Chartered Engineering Consultants (bAIK), file no. 20/17).

Data security

The security of your data is very important to us. However, please be aware that transmissions of data online (such as by email) can have security vulnerabilities. As such, it is impossible to guarantee that data will be completely protected from being accessed by third parties. We cannot accept any liability for damage suffered as a result of such security vulnerabilities.

Your rights

You have a right of access, a right to rectification, erasure and restriction of processing, a right to data portability, a right to withdraw consent and a right to object. If you believe that the processing of your data is infringing the data protection regulations or that your rights as a data subject have otherwise been violated, you can lodge a complaint with a supervisory authority. In Austria, this is the Data Protection Authority.
